Privacy policy

Information upon your personal data processing in accordance with the General Personal Data Protection Regulation, or the so-called RODO.

 

In the wish to comply with requirements set by the Regulation of the European Parliament and of the Council (EU) 2016/679 on the protection of individuals with regard to the processing of personal data, and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, further referred to as the “Regulation”), RADMOT would like to inform you upon your personal data processing rules, as follows:

 

Personal Data Controller

Data Protection Supervisor


The Controller appointed Mr. Paweł Waniek to be your Data Protection Supervisor. You can contact him via his e-mail address: biuro@paod.pl or in writing (to the Controller’s seat address). You can contact your Data Protection Supervisor in all issues as regards your personal data processing, and as regards exercising your personal data processing rights.

 

Personal data categories


This information refers to personal data that have been acquired otherwise than from the person to whom such data refer.

 

The Controller can process the following data categories: personal identification data, address data, and contact data.

 
 

Objectives and legal grounds for your personal data processing

 
Your personal data can be processed by the Controller in the following purposes:

  1. to perform this recruitment process or any future recruitment processes. The relevant legal ground for your personal data to be processed in this respect shall be your consent thereto, i.e. Article 6 (1) (a) of the Regulation, and execution of the Controller’s legal obligations by the Controller, i.e. Article 6 (1) (c) of the Regulation in connection with provisions of the Labour Code;
  2. to execute the Employment Contract that has been concluded with you, or to take the necessary steps prior to Contract conclusion. The relevant legal ground for your personal data processing in this respect shall be Article 6 (1) (b) of the Regulation;
  3. to execute the Controller’s legal obligations arising from the Employment Contract concluded with you (drawing up declarations required by law, human resources and payroll services, calculating and paying payroll remunerations, issuing work health and safety training sheets and periodical work health and safety certificates). The relevant legal ground for your personal data processing in this respect shall be Article 6 (1) (c) of the Regulation;
  4. to grant the Company’s Social Benefits Fund benefits to you. The relevant legal ground for your personal data processing in this respect shall be your consent thereto, i.e. Article 6 (1) (a) of the Regulation;
  5. in the area of processing for statistical purposes or internal reporting purposes. The relevant legal ground for your personal data processing in this respect shall be Article 6 (1) (f) of the Regulation;
  6. promotion and marketing of activities conducted by the Controller during the term of the Contract. The relevant legal ground for your personal data processing in this respect shall be legitimate interests interest pursued by the Controller, i.e. Article 6 (1) (f) of the Regulation;
  7. promotion and marketing of activities conducted by the Controller upon termination of, expiry of, or withdrawal from the Contract. The relevant legal ground for your personal data processing in this respect is consent from the person to whom such data refer, i.e. Article 6 (1) (a) of the Regulation;
  8. to establish and lodge your own claims, or to seek legal protection against claims submitted against you. The relevant legal ground for your personal data processing in this respect shall be legitimate interests pursued by the Controller, i.e. Article 6 (1) (f) of the Regulation.
 

Information on your personal data processing intervals

 

The Controller shall not store your personal data in the following circumstances:

  1. for the period required to complete the recruitment process / for the period required to complete this recruitment process and any future recruitment processes;
  2. in connection with conclusion of the Contract and in order to execute the Contract – for the duration of the Contract, and then for the period and to the extent as required by law, as well as for the period required to establish and lodge your own claims, or to seek legal protection against claims submitted against you;
  3. in the area of processing for statistical purposes and internal reporting purposes – till the time of fulfilment of the Controller’s legitimate interest that constitutes the basis for such processing, or till such time as you file your objection against it;
  4. in the area of promotion and marketing of activities conducted by the Controller during the term of the Contract – till such time as you file your objection against it;
  5. in the area of promotion and marketing of activities conducted by the Controller upon termination of, expiry of, or withdrawal from the Contract – till the time your consent is withdrawn;
  6. in the area of establishing and lodging your own claims or seeking legal  protection against claims submitted against you – till such time as any potential claims resulting from the Contract or from any other reasons are barred by statute of limitations;
  7. in the area of fulfilment of the Controller’s legal obligations – for the period in which legal provisions require the Controller to store the documentation, and to fulfil his obligations towards you which arise therefrom.

 

Monitoring


The Controller shall use visual monitoring in order to protect the property and to provide for the safety of people who are present at the monitored premises. The basis for data processing shall be a legitimate interest of the Controller, i.e. Article 6 (1) (f) of the Regulation. Monitoring recordings shall be stored for the period up to 3 months. The person recorded by the monitoring system shall have the right to access the recording through his or her representative authorised thereto based upon relative legal regulations being in force at this entity, e.g. by the Police. The person recorded by the monitoring system shall have the right to file a complaint with the Personal Data Protection Office.


Information upon your personal data receivers

Your data are intended for the Controller, and they can be transferred to the following receivers:

  1. to the entities or bodies, to which the Controller is obliged or authorised to disclose your personal data based upon generally applicable regulations of the law, including to the entities or bodies which are authorised to receive your personal data from the Controller, or which are authorised to require access to your personal data based upon generally applicable regulations of the law;
  2. to the entities that take part, upon Controller request, in this recruitment process / in future recruitment processes;
  3. to the entities that take part in processes necessary to execute the Employment Contract concluded with you;
  4. to the entities that process your personal data on behalf of the Controller pursuant to a Contract of entrustment of personal data processing, which has been concluded with him.

Automated decision-making, including profiling

 
Profiling should be understood as any form of automated personal data processing, which consists in using your personal data to evaluate some traits of a natural person, in particular to analyse or predict some aspects as regards such natural person’s work, his or her economic situation, health, personal preferences, interests, credibility, behaviour, location or relocation.

 

Bearing in mind the above, RADMOT Limited Liability Company would like to inform you that they do not conduct any profiling of persons to whom such data refer.


Rights of the person to whom such data refer

 
You have the right of access to your personal data, including the right to obtain their copies, the right to demand that they are rectified, removed (the right to be forgotten), and that your data processing is restricted upon conditions that result from the Regulation.

To the extent that the basis for your personal data processing is the circumstance of a legitimate interest of the Controller, you shall have the right to lodge your objection against your personal data processing.

 

To the extent that the basis for your personal data processing is your consent thereto, you shall have the right to withdraw your consent. Withdrawal of your consent shall have no bearing upon conformance of processing which was performed based upon your consent before it was withdrawn.


To the extent that your personal data are processed in order to conclude and execute the Contract or are processed based upon your consent – you shall also have the right to transfer your personal data, i.e. the right to receive your personal data in a streamlined, widely used machine-readable format from your Controller (you can send such data to some other Controller), and the right to demand that your data be transferred directly by RADMOT Limited Liability Company to another Controller, insofar as this is technically possible.


To the extent that your personal data are processed for the purpose of promotion and marketing of activities conducted by the Controller – you shall have the right to file, at any time, your objection against your data processing for the requirements of promotion and marketing of activities conducted by the Controller, including profiling, to the extent that such data processing is connected with promotion and marketing of activities conducted by RADMOT Limited Liability Company.


You also have the right to file a complaint with a body that supervises compliance with the Regulation, i.e. President of the Personal Data Protection Office whenever there occurs a suspicion that your personal data processing may infringe personal data protection regulations.


Source of origin of data

 
This information refers to personal data acquired otherwise than from the person to whom such data refer.
 
Your data may come from the Principal (in case the Principal has obtained the power of attorney), from your legal representative or from any widely available source (e.g. databases or registers, such as: REGON, Central Registry and Information about Business Activities (CEIDG), or the National Court Register).


Personal data transfer to a third country


The Controller will not make your personal data available to any entities based outside the European Economic Area (EEA).
 
 

Duty to provide one’s personal data

 
Providing your personal data is voluntary, but it is necessary for the conclusion and execution of the Contract and statutorily determined rights obligations of the Controller in connection with pursuing the objectives as referred to above. In case you refuse to provide your personal data, the Controller will be forced to refuse to conclude the Contract. To the extent that your personal data are collected based upon your consent, providing your personal data is voluntary.
